Assault and Battery – Dismissed

The police responded to our client’s house to investigate a family dispute. Our client’s brothers told the police that our client was arguing with his mother and shoved her during the argument. Our client then allegedly punched his brother twice. He was charged with two counts of assault and battery. Both counts were dismissed prior to trial.

Assault with a Dangerous Weapon – Dismissed

Our client has two children with her ex-boyfriend. The ex-boyfriend reported to the police that they were arguing about their custody arrangement. During the argument, our client allegedly punched the ex-boyfriend in the head. She then bit him on the wrist and tried to stab him in the stomach with a knife. The police observed injuries to the ex-boyfriend that corroborated his story. In addition to assault with a dangerous weapon, our client was charged with assault and battery. Both charges were dismissed prior to trial.

The police and an ambulance were called to our client’s home to investigate the report of a domestic disturbance. Upon arrival, our client’s wife told the police that our client had pushed her to the ground during the course of an argument. Our client was arrested and charged with assault and battery. Our client was riding in the front seat of a car driven by his sister. Our client and his sister began arguing and the sister told police that our client grabbed the steering wheel several times causing the car to swerve into oncoming traffic. Our client then allegedly threatened to kill his sister and his niece, who was sitting in the back seat. Our client was charged with two counts of assault and one count of threatening to commit a crime. All charges were dismissed prior to trial.

Assault and Battery on a Family Member – Dismissed

Our client was involved in an argument with her husband, who was moving out of the marital home and planning to file for divorce.  The police were called and when they arrived the husband said our client had pushed and scratched him during the argument.  The police saw injuries that were consistent with the husband’s allegations.  Our client admitted to the police that she assaulted her husband.  She was charged with assault and battery on a family member and the case was dismissed prior to trial. 

Violation of a Harassment Order – Dismissed

Our client’s neighbor obtained a harassment order against her, prohibiting our client from having contact with her. The police were called to a disturbance in the street and observed the neighbor to be bleeding from multiple contusions on her face. She also had torn clothing and other visible injuries on her body. She told the police that our client had knocked her to the ground and repeatedly kicked her in the face. The neighbor’s allegation was substantiated by an independent witness. Our client was arrested and charged with violating a harassment order and assault and battery with a dangerous weapon (shod foot). Both charges were dismissed prior to trial.

Our client’s husband called the police to report that he arrived home and our client was sitting at the kitchen table drinking. Our client was involved in arguments with his girlfriend on two separate occasions. On both occasions, the police responded and spoke to the girlfriend. The girlfriend told the police that our client had repeatedly grabbed her around the neck and ripped her telephone from the wall to prevent her from calling the police. Police officers witnessed injuries to the girlfriend that were consistent with her story. Our client was charged with two counts of assault and battery in addition to two counts of intimidation of a witness. All charges were dismissed prior to trial.

Our client’s husband was involved in a dispute with a police officer regarding an illegally-parked truck. The police officer went to our client’s home and argued with the husband. The argument escalated and the officer and the husband began wrestling. Our client then allegedly punched the officer repeatedly in the chest. In addition to assault and battery on a police officer, our client was charged with resisting arrest. Both charges were dismissed prior to trial.

Our client was involved in a heated argument with his girlfriend. According to the girlfriend, our client ripped a picture frame off of her wall during the argument and threw it at her. The ex-girlfriend said our client had punched her in the face, pulled her hair, and thrown her out of his car. Police observed injuries on the ex-girlfriend consistent with her allegations. Our client was involved in an argument with her ex-boyfriend. The ex-boyfriend told the police that during the argument, our client struck him with a shoe and slapped him in the head. Our client’s ex-wife obtained a restraining order prohibiting him from contacting her. After the issuance of the restraining order, the ex-wife told the police that our client had gone to her home, grabbed her by the neck, and shoved her. Our client was arguing with her mother. According to the mother, our client struck her with a framed picture. A police officer observed injuries to the mother that were consistent with her allegations. Our client admitted that she was involved in a physical altercation with her mother. She was charged with assault and battery with a dangerous weapon and the case was dismissed prior to trial.

The police responded to our client’s home for the report of a domestic disturbance. Our client’s wife was visibly upset and told the police that our client had slapped her during an argument. There were independent witnesses who confirmed the wife’s story. Our client was arrested and charged with assault and battery, and the case was dismissed prior to trial.

Our client’s girlfriend called the police and reported that our client had become angry because she was talking to an ex-boyfriend. As the police officers arrived at the scene, they saw our client running toward his neighbor, brandishing a hammer and screaming he was going to kill the neighbor. Our client went to her ex-boyfriend’s house to confront him about his new relationship. According to the ex-boyfriend, our client, who was intoxicated, broke into his house and punched and scratched him in the face. Several independent witnesses confirmed the assault and the police witnessed injuries to the ex-boyfriend that were consistent with his story. Our client was arrested and charged with assault and battery, and the case was dismissed prior to trial.

Our client was involved in an argument with her mother. During the argument, our client admittedly punched her mother in the face. Our client’s mother called the police and reported that our client was trying to break into her house by kicking in the door. She told the police that our client was not allowed in her house. The mother told the police she feared our client was going to hurt her. In addition to assault, our client was charged with vandalizing his mother’s property. Both counts were dismissed prior to trial.

Our client was involved in a fight with his girlfriend. The girlfriend reported to the police that during the fight, our client punched her in the face and threw her on the ground. The police observed injuries to the girlfriend that were consistent with her story. She also told the police that our client had thrown a brick through her apartment window. In addition to assault and battery, our client was charged with malicious destruction of property. Both charges were dismissed prior to trial.

Our client’s ex-boyfriend reported to the police that during an argument, our client struck him several times in the face. Later in the same day, our client and her new boyfriend allegedly drove by the ex-boyfriend. The new boyfriend pointed a gun at the ex-boyfriend. Our 60-year-old female client got into a dispute with her sister.  During the argument, our client allegedly threw a bucket containing urine at her sister, hitting her in the upper body.  The police arrived and our client acknowledged the allegation.  We scheduled the case for trial, where the case was dismissed.

Our client’s estranged wife reported to the police that he had beaten her during an argument.  When the police arrived, they did not see any visible injuries on the wife.  Our client, on the other hand, had a large bruise on his arm that was the result of the wife biting him.  We took pictures of the bruise for presentation to the jury.  Our client was prepared to testify he never struck his wife and the only physical assault happened when his wife bit him.  On the trial date, the wife refused to testify (asserting her Fifth Amendment privilege) and the case was dismissed.

The police interceded and the girlfriend told them that she feared our client was going to hit her. Our client was arrested and charged with assault. The case was dismissed prior to trial.
